There are several defects which may occur when a producer sells his products to customers. It is not expected of him to sell a defective product. There are different types of defects such as design defect or manufacturing defect. The consumers can claim against such defects. Product liability comes under law in which the manufacturer is held responsible for the supply of any sub standard or any hazardous product to their consumers. Sometimes there are defects occurring in the manufacturing off these products and in this place the manufacturing defect liability comes into picture.

In case an error in any of the machines is not corrected it results in the defective production of the entire lot or batch depending on the scale or grade of manufacturing. In case the focus is on the manufacturer then it is termed to be negligence. But sometimes consumers have a focus on the product itself; in that case the claims are known as claims based on strict liability. It is because in this case there will be chances that the manufacturer is not negligent, but the product itself needs a change for the welfare of the consumer. In case of strict liability it is said that the manufacturer is held responsible in spite of him being not negligent. Generally tests for risk- utility and the tests for consumer expectations are conducted. It is important knowing that strict liability is mainly applied in case of defects in manufacturing when the design visualized is different from the intended design. There have been various food products which have been under scrutiny for manufacturing defects.
